These Terms of Service (“Terms”) govern your access to and use of the Smash mobile application for iPhone and Apple Watch (the “App”) provided by Moonshot Media Limited (“we”, “us”, “our”), a company registered in Ireland.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. The App
Smash is a mobile application for scoring badminton. The App lets you keep score rally by rally on iPhone and Apple Watch with the serve and service court tracked automatically; hear the score called aloud before each serve; run club sessions (round robin and king of the court) with live standings; save match history; track head-to-head records between players you add; follow the live score from the Lock Screen and Dynamic Island; and create shareable result card images.
The App is provided by Moonshot Media Limited and distributed through the Apple App Store.
2. Eligibility and Account
If you are under 18, you may use the App only with the consent of a parent or guardian, and any purchase must be made in accordance with Apple’s family purchase rules. The App does not require you to create an account with us. All functionality runs on your device, using your Apple Account for in-app purchases.
3. Licence
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install, and use the App on Apple devices that you own or control, in accordance with the Apple Media Services Terms and the Apple App Store Terms.
You may not:
- Reverse engineer, decompile, or disassemble the App, except as permitted by applicable law
- Sell, lease, lend, or otherwise transfer the App to a third party
- Use the App for any unlawful purpose or in violation of any third-party rights
- Remove or alter any proprietary notices in the App
- Use the App to create a competing product or service
4. Subscriptions and In-App Purchases
4.1 Smash Pro
Scoring matches and the App’s features require Smash Pro. Smash Pro is available as an auto-renewable subscription or a one-time purchase. All options unlock the same features: scoring for singles and doubles, the spoken score caller, club sessions, head-to-head records and the Smash Rating estimate, the Live Activity, and result cards without the Smash watermark.
- Weekly: USD 3.99 per week (or local-equivalent price displayed in the App Store), with a 7-day free trial for new subscribers
- Yearly: USD 29.99 per year (or local-equivalent price), with a 7-day free trial for new subscribers
- Lifetime: USD 59.99 one-time purchase (or local-equivalent price). Not a subscription: it does not renew and applies to your Apple Account permanently.
Auto-renewal: Weekly and Yearly subscriptions automatically renew at the end of each period unless you cancel at least 24 hours before the end of the current period. Payment is charged to your Apple Account at confirmation of purchase and at each renewal. Prices, periods, and any free trial are always shown in the App before you buy.
4.2 Cancellation and Refunds
You can manage or cancel your subscription at any time:
- iOS Settings → [Your Name] → Subscriptions → Smash Pro
Cancelling stops future renewals; the current period continues until expiry. Refunds are handled exclusively by Apple. You can request a refund through Apple at https://reportaproblem.apple.com.
4.3 Price Changes
We may change prices from time to time. Apple will notify you of any subscription price increase before it takes effect, and your continued subscription confirms acceptance of the new price. Price changes never affect a Lifetime purchase already made.
5. Your Content
Match history, scores, and any player names you add belong to you and stay on your device. We have no access to them. You are responsible for the names you enter; only add another person’s name with their agreement, and do not enter sensitive information about other people.
6. Smash Rating
The Smash Rating shown in the App is an informal, in-app estimate computed on your device from the match results you record. It is provided for fun and personal tracking only. It is not an official rating of any kind, and Smash is not affiliated with, endorsed by, or connected to the Badminton World Federation (BWF) or any other rating provider or governing body. Do not rely on the Smash Rating for tournament eligibility or any official purpose.
7. Intellectual Property
The App, including its design, code, graphics, and branding, is owned by Moonshot Media Limited and protected by intellectual property laws. Except for the licence granted in Section 3, no rights are transferred to you. Result card images you create with the App may be shared freely for personal, non-commercial purposes.
8. Updates
We may release updates that add, change, or remove features. Updates may be required for continued use of the App. We are not obliged to provide any particular update or to maintain any particular feature.
9. Data Storage and Backup
All App data is stored locally on your device. We do not operate servers and hold no copy of your data. Your data is included in your normal device backups (iCloud Backup or computer backups) if you have them enabled. Deleting the App deletes its data from the device. The Apple Watch app holds a temporary copy of the live match for scoring, synced directly between your own devices, and club sessions are held in memory for the duration of the session.
10. Health and Fitness
During a match, the Apple Watch app runs a workout session solely so that watchOS keeps the scoreboard active on your wrist. The App does not read, record, or store any health or fitness data, and writes nothing to the Health app. Smash is not a fitness, health, or medical product and provides no health advice.
11. Disclaimer of Warranties
The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that scores will always be recorded, called, or synced without loss.
12. Limitation of Liability
To the maximum extent permitted by law, Moonshot Media Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from or related to your use of the App. Our total liability for any claim shall not exceed the amount you paid for the App in the 12 months before the claim arose. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including under Irish and EU consumer law.
13. Termination
These Terms apply until terminated. We may terminate or suspend your licence if you breach these Terms. You may terminate by deleting the App. Sections that by their nature should survive termination (including 5, 6, 7, 11, 12, and 14) survive.
14. Apple-Specific Terms
These Terms are between you and Moonshot Media Limited, not Apple. Apple has no obligation to provide maintenance or support for the App. In the event of a failure of the App to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App, including product liability, regulatory compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. Governing Law and Disputes
These Terms are governed by the laws of Ireland. Disputes are subject to the non-exclusive jurisdiction of the Irish courts. If you are a consumer in the EU or UK, you also benefit from any mandatory protections of the law of the country where you live.
16. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date above reflects the latest version. Material changes will be communicated through the App or the App Store listing. Continued use after changes take effect constitutes acceptance.
