Terms of Service and Licence Agreement

Welcome to Kaivalya. These Terms of Service (the “Terms”) are a legal agreement between you and Moonshot Media Limited, a company registered in Ireland (“Moonshot”, “we”, “us”), and they govern your use of the Kaivalya app for iPhone and iPad (the “App”). These Terms also serve as the End User Licence Agreement (EULA) for the App.

Please read them carefully. By downloading, installing, or using Kaivalya you agree to these Terms. If you do not agree, please do not use the App.

What Kaivalya Is

Kaivalya is a guided ascent through Patanjali’s eight limbs of yoga, built by integrating the ten yamas and niyamas one principle at a time. It is a private space for reflection and practice, designed to help you move through the path at your own pace.

Kaivalya is a personal reflection and practice tool. It is not medical, psychological, therapeutic, or spiritual advice, and it is not a substitute for professional care. Please see the Health and Wellbeing section below.

Your Licence to Use the App

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use Kaivalya on Apple devices that you own or control, for your own personal, non-commercial use, in accordance with these Terms and Apple’s usage rules.

This licence does not transfer any ownership to you. We and our licensors retain all rights, title, and interest in the App and its content. You agree that you will not:

  • copy, modify, or create derivative works of the App, except as allowed by law;
  • reverse engineer, decompile, or disassemble the App, except to the limited extent that applicable law permits;
  • rent, lease, lend, sell, redistribute, or sublicense the App;
  • remove or alter any proprietary notices; or
  • use the App in any unlawful way or in a manner that could harm the App, our systems, or other people.

We may suspend or end this licence if you materially breach these Terms.

Free Tier and Kaivalya Membership

Kaivalya offers a Free tier and a paid membership. The Free tier lets you explore your Yantra mandala and take the Mirror self-assessment, at no cost, for as long as you like.

Kaivalya membership unlocks the full guided path. There are three membership options, and the pricing is the same in every market:

  • Weekly subscription, with a 7-day free trial;
  • Yearly subscription, with a 7-day free trial; and
  • Lifetime, a one-time purchase (non-consumable) that unlocks everything forever.

You can always upgrade between tiers.

Free Trials, Renewals, and Cancellation

Subscriptions automatically renew until you cancel them. You can manage or cancel a subscription at any time in your App Store account settings. Cancelling stops the next renewal, and your access continues until the end of the period you have already paid for.

If your subscription includes a free trial, the trial converts to a paid subscription unless you cancel at least 24 hours before the trial ends. Payment is charged to your Apple ID at confirmation of purchase, and again at the start of each renewal period unless you have cancelled.

The Lifetime option is a single one-time purchase. There is nothing to renew and nothing to cancel.

Payments and Refunds

All purchases are made through the App Store and are processed by Apple, using the payment method linked to your Apple ID. Moonshot does not see or store your card details.

Refunds for App Store purchases are handled by Apple, not by Moonshot. If you would like to request a refund, please use Apple’s process at https://support.apple.com/refunds. We are happy to help you understand your options, but we cannot issue App Store refunds ourselves.

Your Data

Kaivalya is built to keep your practice private. There is no account and no login, and we do not collect your personal data. Your practice data is stored on your device, and optionally synced privately across your own devices through your iCloud. For full detail, please read our Privacy Policy.

Health and Wellbeing Disclaimer

Kaivalya is intended for general reflection, learning, and personal practice. It does not provide medical, psychological, therapeutic, or spiritual advice, and it is not designed to diagnose, treat, cure, or prevent any condition.

Always use your own judgement, and do not undertake any physical or breathing practice that feels unsafe for you. If you have any health concern, or if you are experiencing distress, please consult a qualified professional. If you enable the optional Apple Health feature, the App only writes Mindful Minutes when you log a reflection; it never reads your health data.

Disclaimer of Warranties

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or fit for any particular purpose. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you. Nothing in these Terms affects your statutory rights as a consumer.

Limitation of Liability

To the fullest extent permitted by law, Moonshot will not be liable for any indirect, incidental, special, or consequential loss arising from your use of, or inability to use, the App. Our total liability to you for any claim relating to the App is limited to the amount you paid for the App, if any, in the twelve months before the claim.

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability under mandatory consumer protections in Ireland, the EU, and the UK.

Apple-Specific Terms

These Terms are between you and Moonshot only, not with Apple. Apple’s Licensed Application End User Licence Agreement (the “Standard EULA”), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, also applies to your use of the App. To the extent of any conflict between these Terms and the Standard EULA in relation to purchases made through the App Store, these Terms supplement the Standard EULA, and the Standard EULA governs where these Terms are silent.

  • Apple has no obligation to provide any maintenance or support for the App. Any support questions should come to us at hi@moonshot.ie.
  • Apple is not responsible for the App or its content, and is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims.
  • In the event of any third-party claim that the App infringes that party’s intellectual property rights, Moonshot, not Apple, is responsible for the investigation, defence, settlement, and discharge of such a claim.
  • You confirm that you are not located in a country subject to a US Government embargo and that you are not on any US Government list of prohibited or restricted parties.
  • Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right to enforce these Terms against you as a third-party beneficiary.

Changes to These Terms

We may update these Terms from time to time, for example to reflect new features or changes in the law. When we do, we will revise the “Last updated” date above. If you continue to use the App after an update, you accept the revised Terms.

Governing Law

These Terms are governed by the laws of Ireland, and the courts of Ireland have jurisdiction, without affecting any mandatory consumer protections you are entitled to under the law of the country in which you live, including in the EU and the UK.
