These Terms of Service (“Terms”) govern your access to and use of the SnagShot mobile application (the “App”) provided by Moonshot Media Limited (“we”, “us”, “our”), a company registered in Ireland.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. The App

SnagShot is a mobile application for iOS that helps construction professionals, surveyors, property managers, and tradespeople create site audit and snagging reports. The App allows you to capture photos, record issues, organise them by project, and generate PDF reports.

The App is provided by Moonshot Media Limited and distributed through the Apple App Store.

2. Eligibility and Account

You must be at least 18 years old to use the App. The App does not require you to create an account with us — all functionality runs on your device using your Apple ID for in-app purchases and (optionally) iCloud sync.

3. Licence

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install, and use the App on Apple devices that you own or control, in accordance with the Apple Media Services Terms and the Apple App Store Terms.

You may not:

  • Reverse engineer, decompile, or disassemble the App, except as permitted by applicable law
  • Sell, lease, lend, or otherwise transfer the App to a third party
  • Use the App for any unlawful purpose or in violation of any third-party rights
  • Remove or alter any proprietary notices in the App
  • Use the App to create a competing product or service

4. Subscriptions and In-App Purchases

4.1 Pro Subscription

The App offers an optional SnagShot Pro Annual subscription that unlocks premium features (unlimited projects, no watermark on reports, premium templates, and other features as described in the App).

  • Price: USD 29.99 per year (or local-equivalent price displayed in the App Store)
  • Free trial: 1 week free, available to new subscribers
  • Auto-renewal: Your subscription will automatically renew at the end of each annual period unless you cancel at least 24 hours before the end of the current period
  • Payment: Charged to your Apple ID at confirmation of purchase, and at each renewal

4.2 Cancellation and Refunds

You can manage or cancel your subscription at any time:

  • iOS Settings → [Your Name] → Subscriptions → SnagShot Pro

Cancelling stops future renewals; the current period continues until expiry. Refunds are handled exclusively by Apple. You can request a refund through Apple at https://reportaproblem.apple.com.

4.3 Price Changes

We may change subscription prices from time to time. Apple will notify you of any price increase before it takes effect, and your continued subscription confirms acceptance of the new price.

5. Your Content

Any content you create in the App (project data, photos, notes, reports) remains your property. We do not claim ownership of, access, or store your content on our servers — see our Privacy Policy for details.

You are solely responsible for the content you create, including ensuring you have the right to capture and use any photos or information of properties or third parties.

6. Intellectual Property

The App (including its code, design, branding, logos, and report templates) is owned by Moonshot Media Limited and is protected by copyright, trademark, and other intellectual property laws. These Terms do not transfer any ownership of the App to you.

“SnagShot”, “Moonshot Media” and associated logos are trademarks of Moonshot Media Limited.

7. Updates

We may release updates to the App from time to time. Updates may add, change, or remove features. By using the App, you agree to receive automatic updates through the App Store (subject to your device settings).

8. Data Storage and Backup

The App stores all your content (projects, photos, notes, reports) on your device. We do not have access to, copies of, or any way to recover your content if it is lost.

The App provides an iCloud Drive backup feature as a convenience to help you transfer or restore your data. This feature relies on your Apple iCloud account and Apple’s services. We do not control iCloud and we cannot guarantee the availability, completeness, or restorability of any backup.

You are solely responsible for backing up your content and for ensuring that any backup you rely on is current and intact. We recommend you back up regularly and keep your own copies of important reports (for example, by exporting the PDF or CSV to a separate location).

You acknowledge that data may be lost or become inaccessible for reasons outside our control, including but not limited to:

  • Device loss, damage, theft, or replacement
  • Operating system updates, factory resets, or app reinstallation
  • iCloud account changes, sign-out, or service interruptions
  • Accidental deletion within the App
  • Restoring an older or incomplete backup

To the maximum extent permitted by law, we are not liable for any loss of, or inability to access, your content, including any consequential losses (commercial, professional, or legal) arising from such loss.

9. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, error-free, or secure
  • Defects will be corrected
  • The App is free from viruses or harmful components
  • The App will meet your specific requirements

Reports generated by the App are provided as a tool to assist you. You are responsible for verifying the accuracy and completeness of any report before relying on it for professional, legal, or contractual purposes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOONSHOT MEDIA LIMITED, ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF, OR INABILITY TO USE, THE APP.

OUR TOTAL LIABILITY UNDER THESE TERMS, FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP, IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR EUR 50, WHICHEVER IS GREATER.

Nothing in these Terms limits liability that cannot be excluded under applicable law (including, where applicable, statutory rights of consumers under EU and Irish law).

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms. You may stop using the App at any time by uninstalling it from your device.

Termination does not affect rights or obligations that accrued before termination, including your obligation to pay any outstanding subscription fees.

12. Apple-Specific Terms

You acknowledge that these Terms are between you and Moonshot Media Limited, not Apple. Apple is not responsible for the App or its content.

  • The licence to use the App is limited to a non-transferable licence to use the App on any Apple-branded device that you own or control.
  • Apple has no obligation to provide maintenance or support for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is not responsible for addressing claims relating to the App or your use of it.
  • In the event of a third-party claim that the App or your use infringes intellectual property rights, Moonshot Media Limited (not Apple) is responsible for investigation, defence, settlement, and discharge.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Governing Law and Disputes

These Terms are governed by the laws of Ireland, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Ireland, except that consumers resident in the EU retain the right to bring proceedings in their country of residence as provided by applicable consumer-protection law.

14. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date at the top of this document will reflect the most recent revision. Material changes will be communicated through an in-app notice or App Store update notes. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
